Terms of Service
These terms cover this website and your Fluxora account. The software itself — the server, the desktop control panel and the mobile apps — is covered separately by the EULA.
If you don't agree with these terms, don't use the site or create an account.
1. Who can use Fluxora
Anyone can install and use Fluxora. To buy a paid plan you must be 18 or older, or the age of majority where you live, since that's a contract.
2. Your account
You need a Fluxora account to use the apps. Keep your password to yourself — you're responsible for what happens under your account, and for anyone you invite to a server you run.
You can delete your account at any time. We may suspend or close an account that breaks section 4, and we'll tell you why.
3. Paid plans
Paid plans aren't available yet. Everything Fluxora currently does is free to use. When purchasing opens, prices and what each plan includes will be published here and on the pricing page before anything can be bought.
When that happens, these will apply:
- Payment is handled by Polar, who act as merchant of record. Their terms cover the transaction itself.
- A paid plan attaches to your account, not to a machine. A server signed in to your account runs at your plan's level.
- Cancelling stops future billing. Your server keeps working — it returns to the free level and carries on. Nothing you have installed stops running because you stopped paying.
4. Acceptable use
Don't use Fluxora or this site to:
- break the law, or infringe someone else's copyright;
- distribute content you have no right to distribute — what you put on your own server is your responsibility, including anything you share with people you invite;
- attack, overload or probe our systems, or anyone else's server;
- resell Fluxora, or run it as a hosted service for other people. The EULA sets out what you may and may not do with the software.
5. Your content, our brand
We claim no rights over anything in your library. We have no copy of it and no way to reach it — see the privacy policy.
The Fluxora name, logo and site design are ours. You may refer to Fluxora and link to it; don't pass your product off as ours or use the branding in a way that suggests we endorse you.
6. Continuity
A server decides what it's allowed to do by reading a tier record cached in its own database, good for 30 days from the last successful refresh. Within that window nothing on our side — an outage, a billing problem, a dispute — stops a server that's already running.
There's no remote kill switch, and we won't add one. If we ever stopped operating, servers would keep running until their cached record expired and then continue at the free level.
7. Third parties
Fluxora relies on Google (Firebase, for sign-in and finding your server) and, for payments when they go live, Polar. Their terms and privacy policies apply to their parts. We're not responsible for services you choose to point your own server at.
8. No warranty
Fluxora is provided as is. We do not promise it will be uninterrupted, error-free, or fit for a particular purpose, and we do not warrant against loss of data. Back up anything you care about.
9. Liability
To the fullest extent the law allows, our total liability for any claim relating to these terms is limited to what you paid us in the twelve months before the claim — which is nothing, if you have not paid us anything.
We are not liable for indirect or consequential loss: lost profits, lost data, business interruption, or the cost of a replacement service.
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
10. Disputes
Email legal@fluxora.marshalx.dev first and give us 30 days. Almost everything can be sorted out that way.
These terms are governed by the laws of the Republic of India, and the courts of Delhi have jurisdiction. If you're a consumer in the European Union, the United Kingdom or California, your local consumer-protection law applies as well, and wins where the two conflict.
11. Changes
We may update these terms. Material changes will be announced in the app before they take effect. Continuing to use Fluxora after that means you accept them; if you don't, delete your account.
12. General
If any part of these terms is unenforceable, the rest still stands. Not enforcing something once doesn't waive it. Neither of us is the other's agent or partner. We may transfer these terms if the project changes hands; you may not transfer your account. Neither side is liable for failures outside its reasonable control. We contact you at the email on your account; you contact us at the address below. These terms and the EULA are the whole agreement between us.
